INDIANAPOLIS (AP) — Attorneys for country duo Sugarland said concertgoers were at least partly to blame for injuries suffered in a stage collapse, drawing a sharp reaction from fans Tuesday and prompting the band's manager to issue a statement criticizing the finger-pointing.

Contributory negligence or comparative fault reduces the damages. they are being sued so unless they feel like losing and paying out for everything the lawyers put out a defense. The quoted attorney should have understood that and added to context by pointing out that its not a particularly good defense but is a valid legal defense.

Sadly, I think her legacy will become less about what she was and more about what she could have been.
